Briefing on denaturalization and practice advisory on risk assessment

The resources below are related to legal advocacy rather than citizenship test preparation. However, teachers who want to get a deeper understanding of the legal aspects of naturalization, particularly with regard to recent policy changes, may find them helpful.

Risk Assessment for Naturalization Applicants (21-page document)

For many noncitizens, naturalization is the best defense against deportation from the United States. Indeed, USCIS lacks the authority to detain or deport a U.S. citizen. However, applying for naturalization can be risky for some individuals because it can instigate immigration enforcement. This concern has increased following President Trump’s February 28, 2025 NTA Memo. The ILRC, NIPNLG, CLINIC, and the Ready to Stay collaborative have written a practice advisory summarizing the most common reasons why USCIS may deny an N-400, providing guidance for ways to screen and avoid an N-400 denial and removal proceedings, and discussing immigration relief options in immigration court.

The National Partnership for New Americans (NPNA), Immigrant Legal Resource Center (ILRC), and the Catholic Legal Immigration Network, Inc., (CLINIC) will provide a community briefing on the ongoing developments regarding denaturalization.

As the efforts to restrict access to naturalization intensifies and enforcement through denaturalization is prioritized, the partners listed above come together to break down the process and counter the misinformation that is being spread to instill fear in communiities that stand to benefit from the security and protection of citizenship.
